Evidence, not legal advice
1. Acceptance and Eligibility
By using the Services, you agree to these Terms and confirm you are authorized to use the relevant documents, accounts, and systems. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization. The Services are not offered for public signup. Asking to be considered does not create an account, a pilot, or a right to use the Services.
2. Service Purpose
Authmarks provides a sealed record of how a document was written, a step where a named person reviews that record before it is sealed, and a way for an authorised person to check the seal. Authmarks is not a legal judgment engine and does not, by itself, determine misconduct, fraud, or intent. These Terms describe the relationship with users. They do not describe how the record is produced.
3. Consent, Recording, and Extension Use
- Recording is consent-gated at document/session level.
- You are responsible for ensuring required notices and consents are obtained for your jurisdiction, organization, and use case.
- If recording is paused, disabled, or not consented, the record says so. It does not fill the gap.
- Indicators in a record are for a person to review. They are not a verdict.
4. Human Review and Sealing
Where configured, human attestation is required before sealing. Sealed records are designed to be tamper-evident and may be retained according to contractual, legal, audit, or organizational policy requirements. Default retention timelines and the circumstances under which a sealed record may or may not be deleted are described in our Privacy Policy retention schedule.
You are responsible for reviewer assignment, review quality, and decisions made using Authmarks outputs.
5. Acceptable Use
You must not:
- Use the Services for unlawful, deceptive, or rights-infringing activity.
- Attempt to bypass, disable, or tamper with security or integrity controls.
- Reverse engineer, decompile, or attempt to extract the methods used by the Services.
- Use the Services to process data you are not authorized to process.
6. Data Protection
Our data practices are described in our Privacy Policy. For enterprise deployments, additional terms (including DPA and regional hosting terms) may apply by contract.
7. Intellectual Property
The Services, including software, interfaces, and documentation, are owned by Authmarks and protected by intellectual-property laws. Provisional patent protection applies. These Terms do not disclose or license those inventions, and nothing on this website is a technical specification of them.
8. Third-Party Services
The Services may integrate with third-party systems (for example Google Docs/Drive, identity providers, or cloud infrastructure). Your use of those systems is governed by the applicable third-party terms and policies.
9. Disclaimers
The Services are provided on an "as is" and "as available" basis. No software can guarantee a complete record in every condition. Users and organizations must apply independent judgment. Public pages describe outcomes only. They are not an offer of the Services to the public, and they are not a description of unpublished methods.
10. Limitation of Liability
To the maximum extent permitted by law, Authmarks will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, or data arising from use of the Services.
11. Suspension and Termination
We may suspend or terminate access for violations of these Terms, security risks, legal requirements, or abuse. You may stop using the Services at any time.
12. Changes to Terms
We may update these Terms. Updated versions are posted on this page with a revised effective date. Material changes may be communicated in-product or by email.
13. Indemnification
To the fullest extent permitted by law, you will indemnify and hold harmless Authmarks, its officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, losses, and reasonable legal fees arising out of or related to: (a) your use of the Services in violation of these Terms or applicable law; (b) content, documents, or accounts you submit, seal, or make accessible through the Services without adequate rights or authorization; or (c) your failure to obtain the notices and consents required by your jurisdiction and use case for recording, sealing, or sharing authorship evidence.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms will be submitted to the exclusive jurisdiction of the courts of England and Wales, except that either party may seek injunctive relief in any court of competent jurisdiction to protect confidential information, intellectual property rights, or the integrity of sealed records.
Nothing in this section limits statutory rights that consumers or data subjects have under local law, including rights described in our Privacy Policy (for example, GDPR Articles 15, 17, and 20 for individuals in the EEA/UK).
